Hi, we’re Envato (Envato, we, our, or us)! Thanks for taking an interest in our #MadeWithEnvato Out of This World Competition (we’ll call this the Promotion). These are our terms for the Promotion. By participating in the Promotion, you’re agreeing to these terms, so it’s important that you read and understand them.

1. Promoter: This promotion is run by Envato Pty Ltd whose registered office is at 551 Swanston Street, Carlton 3053 Victoria, Australia.
   
2. Entry Period: Entry into the Promotion opens on Tuesday 4 October 2022, 12:01am Australian Eastern Daylight Time(“AEDT”) and closes on Friday, 28 October 2022, 11:59pm AEDT. No entries will be accepted after this period. Important Note: All dates and times listed throughout these terms and conditions are in AEDT. Entrants are solely responsible for determining the corresponding time in their respective territories.
3. Eligibility: This Promotion is open to residents worldwide and/or where Envato Elements is available. You must have, at minimum, a free Envato Elements account, and  must be at least 16 years of age to enter this Promotion (if you’re under 18 years of age please get your parent or guardian’s permission to enter). Any individuals who are employees of Envato, or their immediate family members, are not eligible to enter.
4. Entry Limits: Only one entry per person is allowed.
5. How to Enter: To enter the Promotion you must:
   a) Visit the Promotion website located at https://env.hubskit.com/pm/campaign/out-of-this-world-competition/
   b) Download the collection of free Elements items (the “Free Elements Items”) made available via a link on the Promotion website. If you are not an existing Elements account holder, you will be required to sign up for a free account to download the Free Elements Items. 
   c) Create a piece of digital artwork (the “Artwork Entry”) using the Free Items* that depicts the theme of “Out of This World” (all things space!).
   d) Log-in (or sign up) to Instagram, and post your Artwork Entry on Instagram as an Instagram reel or post, using the hashtags #MadeWithEnvato and #OOTW on Instagram and tagging @Envato.

    *By using Free Elements Items, you agree to comply with our Free Files Single Use Policy and Privacy Policy.

6. Prizes:
   a) There will be three prizes in total comprising of one (1) Grand Prize, (1) Runners up Prize and (1) People’s Choice Prize as follows:
   

   Grand Prize

   • One (1) Wacom One with AL-star Digital Bundle valued at a maximum of USD$474.90.
   • One (1) Annual  Envato Elements unlimited creative subscription valued at a maximum of USD$198

   Runner Up Prize 

   • One (1) Wacom Intuos Wireless Graphic Tablet with Bonus Software Included, 10.4″ X 7.8″  USD$199
   • One (1) Annual  Envato Elements unlimited creative subscription valued at a maximum of USD$198

   People’s Choice Prize

   • One (1) Wacom Intuos Wireless Graphic Tablet with Bonus Software Included, 10.4″ X 7.8″  USD$199
     
   • One (1) Annual  Envato Elements unlimited creative subscription valued at a maximum of USD$198

   The total prize value for this Promotion is USD$1,466.90.

   b)To avoid doubt, a Grand Prize Winner or Runner Up is eligible to win the People’s Choice Prize. (See Clause 7).

   c) Where the prize is a 1 year subscription to Envato Elements (“Subscription”), each winner acknowledges as follows:

   • After the first year, your Subscription will automatically renew on an annual basis at the then current annual subscription fee. You can cancel any time before the renewal date, and still have access to Envato Elements for the initial subscription period. 
   • Each winner of a Subscription will receive a unique link (“Link”) that will direct the winner to sign up to Envato Elements. At the checkout, a coupon for an annual (1 year) subscription will be applied. 
   • If you are an existing Envato Elements subscriber, please let us know and we will provide assistance to make sure you are able to redeem your Subscription prize.  
   • The Link will be sent to the winner’s Instagram account, so please make sure you check your Instagram messages!
   • As a condition of subscribing to Envato Elements: 
     • you need to be 18 years or over to become a subscriber. If you’re under 18 you will need to get a parent or legal guardian who is at least 18 years of age to become a subscriber, and you will need their permission to use the Elements account. This adult will be responsible for all your activities on Envato Elements; 
     • you (or your parent or legal guardian if you are under 18) must provide valid payment details for automatic renewal payments after the 1 year Subscription period has expired; and
     • you (or your parent or legal guardian if you are under 18) must accept Envato’s User Terms and Privacy Policy.
7. Judging
   
   a) Grand Prize Winner and Runner Up
   (i) The Grand Prize Winner and Runner Up will be selected based on a game of skill. Chance plays no part in determining these winners.
   (ii) Judging of valid entries to select the Grand Prize Winner and Runner Up will be conducted on Monday 31 October 2022.  
   (iii) The entries will be judged on set criteria by a panel of appropriately qualified judges. Judges will be looking for any combination of interesting, creative, high quality, or unique projects/work created using the Free Elements Items which also satisfies the requirements set out at Clause 5.

   b) People’s Choice Winner
   (i) A shortlist of a minimum of 9 entries will be selected by the judges, based on the judging criteria at Clause 7(a)(iii).
   (ii) The shortlist will be posted on Instagram on the Envato Instagram account at 12.01am AEDT on Friday 4 November 2022.
   (iii) The People’s Choice Winner will be selected by the Envato Instagram community who will vote on the entry that best depicts the creativity and theme of the Promotion.
   (iv) Voting for the People’s Choice winner will close at 12:01am AEDT on Monday 7 November 2022.

   c) All decisions made about this Promotion by the judges are final and no further correspondence will be entered into.

   a) We will notify all winners via Instagram direct message on Monday 7 November 2022. All reasonable attempts will be made to contact each winner within 48 hours of this date.
   b) All winners must claim their prizes by 5:00pm AEDT on Monday 14 November 2022 (“Prize Claim Deadline”).
   c) If a prize is not claimed by the Prize Claim Deadline, or a winner is deemed ineligible to enter the Promotion and claim a Prize, Envato may award that unclaimed prize to the next eligible entrant, or in its sole discretion, forfeit that prize and no substitute will be offere

General Terms

9. Entry into the Promotion is free (except for any normal internet or mobile connection charges that may apply).

10. This Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. You acknowledge that any information provided in connection with the Promotion is provided to Envato and not to Instagram. Any questions or comments regarding the Promotion must be directed to Envato.

11. If you are a winner, you agree that:

a) You may not request that your prize be exchanged or substituted for cash or alternative goods and services, and you cannot sell or transfer your prize to any other party.

b) In the event that your prize is unavailable for any reason, Envato may replace your prize with another prize of equal value.

c) If you are not able to take the prize as stated, you will forfeit the prize and no payment or compensation will be made in lieu. 

d) Once the prize has left Envato’s premises for delivery (or in the case of a Subscription, has been emailed to the email address provided by the winner), Envato takes no responsibility for the prize being damaged, delayed or lost in transit. 

e) Envato may ask that you or your parent/legal guardian provide proof of your age, identity and residency, and to sign any required documentation including release forms, as a condition of claiming your prize.

g) Envato accepts no responsibility for any variation in the value or the make-up of the prize or any event that occurs that is beyond Envato’s reasonable control. 

12. By entering this Promotion: 

a) You (or your parent/guardian) grant us a perpetual, worldwide, royalty-free non-exclusive license to use your entry (and any content associated with your entry) for the purposes of managing this Promotion and for any other promotional or marketing activity we do, including re-posting or re-sharing your Entry on our online platforms (including social media).  

b) You (or your parent/guardian) hereby grant to us the right to use your name (including any Envato-related username), likeness and biographical data in connection with the marketing and publicity of the Promotion. 

c) You (or your parent/guardian) warrant that any information you give to us is true and correct and your entry (including the Artwork) is your own original creation and work, and does not infringe the rights (including intellectual property , privacy and/or confidentiality rights) of any other person. You (or your parent/guardian) will indemnify us in relation to any loss or damage resulting from any breach of this promise whether it is on purpose or not. 

13. You (or your parent/guardian) consent to our using of your information for the purposes of managing and administering this Promotion, and for any other purpose for which we have received your express consent (including if we have received an “opt-in” to receive marketing communications. If you do not provide us with certain information, you may not be eligible to participate in the Promotion or receive a prize. If the law requires it, we may report the prize winner and prize details to the relevant tax authorities. 14. Play fair! We reserve the right not to award prizes and to disqualify entrants if they do not meet one or more of the requirements set out in these terms and conditions, if their entry includes objectionable material or infringes the rights of any third party or if an entrant tampers with the Promotion in any way. We may in our sole discretion, discontinue the Promotion its entirety, if there is any illegal or fraudulent behavior by entrants or cancel the Promotion if there are any circumstances that mean the Promotion can’t be run as planned, this includes technical issues, hacking, natural disasters and anything else beyond our control.

15. Envato will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) in connection with this Promotion, or for personal injury suffered or sustained as a result of receiving or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
